PHILADELPHIA – Prosecution witnesses say a street racer was going 79 miles an hour when he struck and killed a Philadelphia woman and her three young sons as they crossed a city boulevard in Philadelphia.
An accident investigator estimates that 23-year-old Samara Banks was 1.3 seconds from the curb when her family was struck the night of July 16.
A judge has upheld third-degree murder charges against 23-year-old Khusen (KOO'-sen) Akhmedov (OCK'-muh-dov). He told police he saw the family after cresting a hill, but could not avoid them.
Witnesses say they saw the Lancaster man racing 30-year-old Ahmen Hollomon of Philadelphia before the crash.
A judge dropped the murder charges against Hollomon, but he still faces DUI-homicide and reckless endangerment counts.
Akhmendov's attorney calls the crash an accident.
